Terms of Service

PackPricer provides a packaging cost benchmarking platform that lets businesses compare their packaging prices against aggregated market data and access tools to reduce costs (the "Service"). The Service is operated by PackPricer ("we", "us", or "our").

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization. By using the Service you represent that you meet these requirements.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate, current, and complete information when registering and keep it up to date.
• You must notify us immediately at support@packpricer.com if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that violate these Terms.

• Paid plans are billed in advance on a monthly or annual basis through Stripe. All fees are non-refundable except as required by law or as stated in our refund policy.
• You authorize us to charge your payment method on a recurring basis until you cancel.
• We may change plan pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• To cancel, go to Settings → Plan & Billing → Manage billing. Cancellations take effect at the end of the current billing period; you retain access until then.
• Failed payments may result in suspension of paid features. We will attempt to notify you before suspending your account.

You agree not to:

• Use the Service to infringe any third party's intellectual property, privacy, or other rights.
• Reverse engineer, scrape, or systematically extract data from the Service beyond what is permitted by your plan's API access.
• Use the Service to transmit malware, spam, or any harmful or unlawful content.
• Attempt to gain unauthorized access to any part of the Service or our infrastructure.
• Resell or sublicense access to the Service without our written consent.
• Use the Service in a way that violates any applicable law or regulation.

You retain ownership of all pricing data, SKU details, and other content you submit to the Service ("Your Data"). By submitting Your Data you grant us a limited license to store, process, and display it solely to provide the Service to you.

We use anonymized, aggregated data derived from Your Data to improve benchmark accuracy. No personally identifiable information or your specific pricing data is shared with other users or suppliers.

You can export or delete Your Data at any time from your account settings. Upon account deletion we will remove Your Data within 30 days except where we are required by law to retain it.

Benchmark results are derived from aggregated supplier quote data and are provided for informational purposes only. They do not constitute financial, legal, or procurement advice. Market rates vary by geography, volume, material costs, and supplier relationships. We do not guarantee that any price shown can be obtained from any specific supplier.

Always verify pricing independently before making procurement decisions.

The Service, including its design, software, benchmark methodology, and content (excluding Your Data), is owned by PackPricer and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

The Service integrates with third-party providers including Stripe (payments), Supabase (database), Resend (email), and Anthropic (AI). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the acts or omissions of third-party providers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKPRICER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

You agree to indemnify and hold harmless PackPricer and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Data, or your violation of these Terms.

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases. Sections 6 (Your Data), 7 (Benchmark Data), 8 (IP), 10–12 (Disclaimers, Liability, Indemnification), and 15 (Governing Law) survive termination.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
